Request for Clarification on Union Jack Flags on Quicks Road and Council Policy

We are writing to request clarification of the Council’s policy and position regarding the display of Union Jack flags on Quicks Road and surrounds, particularly in relation to the “Roadside Banners” guidance published on the Council’s website: https://www.merton.gov.uk/ streets-parking-transport/ streets-and-pavements/ roadside-banners On several occasions, Union Jack flags have been placed overnight following marches, while they are rarely, if ever, displayed during nationally significant occasions such as Remembrance Day, the King’s Coronation, or the Olympics. This raises concerns about the selective use of a national symbol and whether such displays comply with the Council’s stated regulations and values. According to the Council’s guidance, permission is required for banners or similar items displayed on council-owned roadside property, with restrictions on location, installation method, and safety. Unauthorised or unsafe installations may be removed, and costs may be recovered from those responsible. In light of this, I would be grateful if you could clarify the following: Are Union Jack flags considered “banners” under the Council’s policy, and therefore subject to the same permissions and restrictions? Were the flags currently displayed on Quicks Road installed with the proper permissions? Who is now responsible for the maintenance and upkeep of these flags once installed? In the event that any flags become loose or detached and cause damage or harm to passersby, vehicles, or property, who would bear responsibility and liability? Does the Council have any oversight mechanism in place to ensure that installations remain safe and compliant over time? Finally, what is the Council’s position on the selective use of national flags – i.e. displayed for marches but not for key national occasions – and whether this aligns with community standards or Council values? We believe a clear and transparent policy will help ensure that public spaces remain safe, inclusive, and respectful of the symbols that belong to us all. Thank you for your attention to this matter.
