Arthur Road - Tree roots causing structural damage to garden wall and pavement

Sent to Merton Council less than a minute later. Council ref: SRQ-1272945-L5J7D6.

Outside No. 32 Arthur Road the Oak tree roots have caused the front garden wall to split and it is at risk of falling down. The tree has also caused uplift to the front garden and the pavement to the side of the tree. It is dangerous for people walking on the pavement and when cars are parked outside of the house it is impossible for anyone in a wheelchair or pushing a pram to proceed without going into the road. This has been an ongoing issue for a number of years.

  • Thank you for your report. As our understanding, this tree is near the end of Arthur Road that's not a busy section. And most residential houses nearby have their own driveways. We understand that the roots of street trees can sometimes cause damage to roads or pavements. Our Highways team have inspection and maintenance programme in place to repair any damage and prevent trip hazards. This upkeep is part of the shared cost of enjoying the many benefits that street trees bring to our community.     For tree root damage within your property boundary, we are unable to carry out repairs in private property. Besides, it cannot be suitably or satisfactorily controlled by pruning. However, you may submit a damage claim and then arrange the repairs yourself by the compensation if approved.     During repairs, you may cut back some tree roots within your boundary. Your builder may also be able to advise on the best way to manage the conflict between the tree roots and your garden wall while helping to preserve this valuable tree.

    According to Merton Council’s policy document: Tree Strategy 2023–2029 and common law precedents: Residents have right to prune encroaching roots up to their property boundary, provided the tree is not protected (e.g. by a Tree Preservation Order or in a conservation area). The pruned material remains council property, but you do not need to return it and please dispose of in legal and appropriate manner. Please note that access to council land is not permitted during such work for safety reasons.
